1. Who we are

“1VPS.nl” refers to the provider of the Service.

2. Accounts & Eligibility

• You must provide accurate information and keep it up to date.
• You are responsible for activities under your account and for maintaining secure credentials.
• We may require verification to prevent fraud or abuse.

3. Orders, Provisioning & Instant Activation

• VPS services are provisioned automatically once payment is confirmed. Dedicated servers may require manual review or stock confirmation.
• Provisioning time may vary due to fraud checks, system load, or availability.
• Service term begins when the Service becomes available in your control panel.

4. Billing, Extensions & Top-ups

• Pricing is shown before checkout. Taxes may apply based on your location.
• You can extend your Service at any time by 7, 30, 90, or 180 days.
• You may top up your account balance (“wallet”) and use it to pay invoices or extensions.
• Crypto payments are supported for eligible orders; on-chain confirmation times and network fees apply. Chargebacks are not available for crypto payments.
• Invoices are due upon receipt. We may suspend or terminate Services for unpaid invoices.

5. Refunds

Refund eligibility is defined in our Refund Policy and applicable consumer law. Some products (e.g., Dedicated Servers, custom setups, or abuse-flagged services) may be non-refundable. Crypto refunds, if any, are issued as account credit unless required otherwise by law.

6. Acceptable Use

You must use the Service lawfully and responsibly. Prohibited uses include (non-exhaustive):

• Illegal content or activities; infringement of intellectual property rights.
• Abuse such as DDoS, port scanning at scale, malware, spam, botnets, or unauthorized access attempts.
• Activities that disrupt network or platform stability, or degrade other customers’ experience.

We may suspend or terminate Services for AUP violations at our reasonable discretion.

7. Data, Backups & Security

• You are responsible for your data, configurations, and backups. Optional snapshots/backups may be available but are not a substitute for your own backup strategy.
• You are responsible for securing your applications and access credentials.

8. Service Changes & Maintenance

• We may modify or discontinue features with reasonable notice where practical.
• Planned maintenance will be communicated through status pages or email when possible.

9. Support

Support is available via the account panel and knowledge base. Response times may vary based on priority and volume.

10. Limitation of Liability

To the maximum extent permitted by law, 1VPS.nl is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business opportunities. Our total liability for any claim relating to the Service is limited to the amount you paid for the Service during the 30 days preceding the event giving rise to the claim.

11. Suspension & Termination

• We may suspend or terminate the Service for violations of these Terms, AUP, non-payment, or as required by law.
• Upon termination, your right to use the Service ends, and data may be deleted after a retention period.

12. Governing Law

These Terms are governed by the laws of the jurisdiction where 1VPS.nl is established. Venue and jurisdiction will follow that location’s competent courts. Company details and legal seat should be specified in your imprint/contact page.

13. Changes to These Terms

We may update these Terms from time to time. Changes take effect upon posting. If a change materially affects your rights, we will provide reasonable notice.
